Welcome to Daat ("Daat", "the app", "the Service", "we"). These Terms of Use ("Terms") govern your use of the app, the website, and any related service. By using the Service you fully and unconditionally agree to these Terms and to the Privacy Policy. If you do not agree, please do not use the Service.

1. The Service

Daat is a consumer information tool that lets you scan barcodes and labels of food products and shows information and suitability indications for the lifestyle you have defined, including kashrut level, allergens, sensitivities and nutritional composition. The Service is intended to provide information and assistance only, and is not a substitute for reading the physical product label or consulting a qualified professional.

2. Nature of the Information; No Reliance

The information in the Service is provided "as is" and for general informational purposes only. The information, suitability verdicts, labels and recommendations do not constitute medical, nutritional, religious (kashrut) or other professional advice, and must not be relied upon as the sole or primary basis for decisions concerning your health, diet or beliefs.

3. Allergy and Health Warning

If you or anyone on your behalf suffers from an allergy, sensitivity, medical condition or dietary restriction of any kind, you must always read the ingredient list and warnings printed on the product packaging itself before every consumption, and consult a physician, dietitian or qualified professional.

Product formulations change from time to time without notice, and manufacturing processes may cause cross-contamination (for example traces of nuts, gluten or milk) that is not necessarily reflected in the Service. Daat bears no liability for allergic reactions, health damage, or any outcome arising from reliance on the information in the Service. The decision of what to consume is your sole responsibility.

4. Accuracy and Completeness of Data

Product data comes from various sources, including public databases, manufacturers, retailers, automatic text recognition (OCR) and user contributions. We cannot guarantee that the information is accurate, complete, up to date or free of errors, and there may be discrepancies between the information shown and the actual product. Use of the information is at your own risk.

5. Kashrut

Kashrut markings in the Service are indicative only and are not a substitute for checking the kashrut certification and certifying body printed on the product. In any case of doubt, rely on the physical marking and on the authorized certifying body.

6. Age and Capacity

Use of the Service is permitted to those aged 16 and over (or the age set by applicable law), and to anyone legally competent to enter into a binding agreement. Minors may use the Service only under the supervision and with the consent of a responsible adult.

7. User Account

If an account is required, you are responsible for keeping your login details confidential and for all activity carried out in your account, and you undertake to provide accurate and up-to-date information.

8. User Content and Reports

To the extent you submit information, images, corrections or product reports, you grant Daat a worldwide, non-exclusive, royalty-free and perpetual license to use, process, display and incorporate that content into the database and the Service. You represent that you are entitled to submit such content and that it does not infringe any third-party rights.

9. Intellectual Property

All rights in the Service, including the design, logo, code, database and content, are reserved to Daat. You may not copy, reproduce, scrape, reverse engineer or make commercial use of the Service or its content without prior written permission.

11. Availability of the Service

The Service is provided "as is" and "as available", without any warranty of continuous availability, correctness, accuracy or freedom from faults. We may change, suspend or discontinue the Service or parts of it, permanently or temporarily, at any time and without prior notice.

12. Limitation of Liability

To the maximum extent permitted by law, Daat, its directors, employees, partners and suppliers shall not be liable for any direct, indirect, special, consequential, punitive or incidental damage, including bodily injury, health damage, loss of data, loss of profit or damage to reputation, arising from the use of or inability to use the Service, from reliance on the information, or from errors, inaccuracies or omissions in the data.

To the extent any liability applies notwithstanding the above, its total scope shall not exceed the amount you actually paid for the Service (if any) in the three months preceding the event giving rise to the claim, or ILS 100, whichever is lower.

13. Indemnification

You undertake to indemnify and compensate Daat for any claim, demand, liability, damage or expense (including attorney's fees) arising from your breach of these Terms, misuse of the Service, or infringement of third-party rights.

14. Changes to the Terms

We may update these Terms from time to time. The last updated date appears at the top of the page. Continued use of the Service after an update constitutes acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms and the use of the Service are governed solely by the laws of the State of Israel. Exclusive jurisdiction over any matter relating to these Terms or the Service shall lie with the competent courts of the Tel Aviv-Jaffa district.
